Knowledgeable attorney helps those harmed in motor vehicle accidents

If you have been injured in a motor vehicle accident, we can help you seek compensation for past and future medical costs, lost income and other expenses. Our clients include those harmed in motorcycle accidents and truck accidents, which often result in serious injuries, as motorcyclists lack the protection that a car provides, and the sheer size of semi trucks and other trucks makes others on the road particularly vulnerable if there is a problem. We can provide valuable advice as to your legal options following an accident.

Understanding Florida’s no-fault insurance system

An important thing to understand when you have been in a car accident in Florida is that the state follows a no-fault insurance system. This means that your own personal injury protection (PIP) insurance coverage will pay for your injuries up to the limits on your policy. Drivers are required to carry a minimum of $10,000 in PIP coverage. The no-fault system also limits you in bringing a legal liability claim against the driver who caused your injuries, as your injuries must meet the serious injury threshold set by state law. Per the statute, a serious injury is defined as:

  • Significant and permanent loss of an important bodily function
  • Permanent injury within a reasonable degree of medical probability other than scarring or disfigurement
  • Significant and permanent scarring or disfigurement
  • Death

Property damage does not fall under the no-fault system. There are no limits on claims for property damage against at-fault drivers. We can help you determine what you may be entitled to in your case and from whom.
